Scott, of the county of Northampton and state of Virginia, do hereby, being of sound mind and disposing memory, make and ordain this is for my last will and testament revoking all former wills made as follows:

1st Upon the condition that my wife" "Elizabeth M. Scott relinquish all her right of dower in my estate, I do hereby empower William M. Scott, my hereinafter named executor to the said Elizabeth M. Scott annually during natural life the sum of One Hundred and twenty dollars ($120.00) and at her death to pay to my son Joseph J Scott the sum of Two thousand dollars.

2nd I bequeath to my daughter Henrietta Scott, the farm, and appurtenances whereon Custis Willis now lives which I purchased, I purchased of Washington Hunt, upon the following conditions viz: I hereby empower my executor to rent out the said farm until, or sufficiently long to pay a certain debt of about $1000.00 and the interest thereon which I owe to Washington Hunt for the purchase of the said land. If the said Henrietta Scott should depart this life leaving no children, the said land is to revert back to my estate to be disposed of by my executor as the rest of my estate as hereinafter named. Should the said Henrietta Scott depart this life leaving child or children the said land to be inherited by them and their heirs forever, subject to the same condition of the payment of the said $ 1,000.00 and interest thereon as named above.

3. I give and bequeath the whole balance of my estate, both real and personal to my son William M. Scott upon the following conditions viz: 1. The said William M. Scott shall pay for my wife Elizabeth M. Scott in lieu of her dower in my estate the sum on One Hundred and twenty dollars annually during her life, and at her death to pay her son Joseph J. Scott the sum of $ 2,000.00 as before stated. 2. The said William Scott shall pay all my just debts as soon after my decease as conveniently may be. 3. He shall pay out of the rents of the farm whereon Curtis Willis now lives which I purchased of Washington Hunt the debt of $ 1,000.00 or thereabouts and interest which I owe for said land, and then dispose of said land as heretofore named. 4. The said William M. Scott shall pay to my son, John G. Scott, and to my grandchildren William A. Dix and William J. Wilson each, five hundred dollars ($500.00) and to my grandson Jesse Wilson the sum of Four hundred and sixty dollars ($460.00) as soon as in the judgement of the said William M. Scott he can conveniently do so, after all my debts are paid.

5. The said William Scott shall clothe, educate and raise my son Joseph J. Scott until the death of my said wife, and then to retain in his hands as guardian of the said Joseph J. Scott the sum of two thousand dollars ($2,000.00) which said $2,000.00 I do hereby give and bequeath to my said son Joseph J Scott to be paid by my executor as thus stated.

6. I leave it optional with my executor to give or not to my son Azariah F. Scott the sum of $ 230.00, the same being the difference between a certain debt I paid as security for the said Azariah F. Scott amounting to about ($530.00) Five hundred and thirty dollars several years ago, and on open account which I owed the said Azariah F. Scott amounting to $ 300.00. The said amt of $ 230.00 to be paid by my executor to the said A. F. Scott if in his judgement he is able to do so after my just debts are all paid.

And lastly I do herby nominate and appoint the said William M. Scott sole executor to this my last will and testament and request that the court shall not exact security of said executor when he shall qualify as executor of my estate. And I do hereby request that my said executor shall appoint some suitable person to carry out the provisions of this will in case of his death, and should he fail so to do. I do hereby request that the county court of Northampton County shall make such appointment.

In witness whereof, I the said testator William W. Scott, have to this, my said last will, set my hand and seal, this the first day of March A.D. 1862

At a court held for Northampton County the 11th day of August 1862, This last will and testament of William W. Scott deceased was proved by the oaths of Luther Nottingham and Joakim Wilkins, two of the subscribing witnesses thereto, and ordered to be recorded. And William M. Scott, the executor in the said will named appearance in court and refuses to take upon himself the execution thereof. And on the motion of Luther Nottingham, who took oath and together with Leonard B Nottingham and John J. Scott, his securitie3s, entered into a bond in the penalty of fifteen thousand dollars, certificate is granted the said Luther Nottingham for obtaining letters of administration on the said decedent’s estate with his will aforesaid annexed in due form. Which bond was acknowledged by the several obligors therein and ordered to be recorded.
